In the event of an unjustified delay by the PROVIDER with respect to the refund of the total amount, the USER may claim to be paid twice the amount due, without prejudice to his right to be compensated for the damages suffered that exceed this amount.
The PROVIDER will not assume any responsibility in the event that the activation of the service does not end up being carried out, if the data provided by the USER are false, inaccurate or incomplete.

If any breakdown occurs in the electrical installations or appliances during the rental period, the USER must immediately notify AGUSTI IGNACIO FABRA to resolve these incidents as soon as possible.

It is forbidden for the USER to assign, transfer or transfer the rights, responsibilities and obligations contracted.
If any stipulation of these conditions is considered null and void or impossible, the validity, legality and compliance of the rest will not be affected in any way, nor will it undergo any modification.

The PROVIDER will be liable to the USER for any lack of conformity at the time of delivery of the accommodation. AGUSTI IGNACIO FABRA recognizes the USER's right to repair the service, to replace it, to reduce the price and to terminate the contract.

The necessary expenses incurred to resolve the non-compliance of the contracted services must be free of charge for the USER.

If, once the repair has been completed and the property has been delivered, it still does not comply with the contract, the USER may demand its replacement, price reduction or termination of the contract.
If the replacement fails to bring the property in accordance with the contract, the USER may demand its repair, reduction of the price or termination of the contract.
The reduction of the price and the termination of the contract will proceed, in accordance with the choice of the USER, if the USER cannot demand the repair or replacement of the service and in cases where they have not been carried out in a reasonable time or without further inconvenience to the USER.
Resolution is not appropriate when non-compliance is of minor importance.
The price reduction must be proportional to the difference between the value that the product would have had at the time of delivery if it had been in accordance with the contract and the value that the product actually delivered had at the time of delivery.

In the event that the USER is domiciled outside of Spain, the PROVIDER and USER expressly waive any other forum by submitting to the Dispute Resolution Body which will act as an intermediary between the two in accordance with art. 14.1 of Regulation (EU) 524/2013, without the need to resort to the courts.
